Terms of Service

These Terms of Service ("Terms") are an agreement between you and Keith Martin, who operates Fret Science (fretscience.com and the related online courses — the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Fret Science offers online guitar courses through Patreon membership and one-time purchase.

Eligibility and your account

You must be at least 18 years old, or the age of majority where you live, to create an account; if you are between 13 and that age, you may use the Service only with the involvement of a parent or guardian. You agree to provide accurate information, to keep your login credentials secure, and that you are responsible for activity under your account. Notify us promptly of any unauthorized use.

Access and memberships

Access to lesson content is granted to:

• Active Patreon supporters at qualifying tiers, for as long as the membership is active;
• Purchasers who buy access through our store; and
• Others we grant access to directly.

Your access is personal to you and tied to your membership, purchase, or invitation. If your Patreon membership ends or is downgraded below a qualifying tier, the corresponding access may end. Features, content, course structure, and availability may change, be limited, or be discontinued from time to time, and we may add, modify, or remove tiers and access levels.

Acceptable use

The Service and its content are provided for your own personal, non-commercial learning. You agree not to:

• Share your account or login, or let others access content through your account;
• Copy, download (except where a download is expressly offered), record, redistribute, publicly perform, resell, or repost the videos, backing tracks, or other materials;
• Circumvent, disable, or interfere with access controls, video protection, or security features;
• Use automated means to scrape or harvest content or data; or
• Use the Service unlawfully or in any way that harms the Service or other users.

Intellectual property

All content in the Service — including videos, audio, text, diagrams, downloadable materials, and the site itself — is owned by Keith Martin / Fret Science or its licensors and is protected by copyright and other laws. We grant you a limited, personal, non-transferable, revocable license to access and view the content you are entitled to, for your own learning, while your access is active. No other rights are granted.

Payments, subscriptions, and refunds

Memberships are managed and billed by Patreon, and one-time purchases are processed by Shopify, each under its own terms; we do not store your full payment-card details. You can manage or cancel a Patreon membership in Patreon at any time, which stops future charges.

Our courses are digital content that you can access immediately after purchase. If you are a consumer in the EU or EEA (or a country with equivalent rules), you have a 14-day right of withdrawal on purchases made online — but for digital content supplied immediately, that right ends once access begins, provided you asked for immediate access and acknowledged that you would lose the right of withdrawal. We ask for that consent at checkout so you can start right away. Where the right of withdrawal still applies, you can exercise it using our withdrawal form; we will refund your original payment, to the same method you used, within 14 days and remove access to the withdrawn course.

Except where the right of withdrawal applies, where a refund is required by law, or where stated at the time of purchase, payments are non-refundable. Nothing in these Terms limits the mandatory consumer-protection rights you have under the law of your country.

Your feedback

If you send us feedback, suggestions, or ideas, you grant us a non-exclusive, royalty-free, perpetual license to use them to operate and improve the Service, without obligation or compensation to you.

Third-party services

The Service relies on and links to third-party services (such as Patreon, Shopify, Clerk, and our video provider). We are not responsible for those services, and your use of them is governed by their own terms and privacy policies.

Disclaimers

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure. Educational content is provided for general instruction and is not professional advice.

Limitation of liability

To the fullest extent permitted by law, Keith Martin / Fret Science will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, use, or profits, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars (US$50).

Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or its users. Provisions that by their nature should survive termination — such as intellectual property, disclaimers, and limitation of liability — will survive.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above, and your continued use of the Service after the changes take effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict-of-laws rules, and you agree that disputes will be handled in the state or federal courts located in Massachusetts, except where applicable law gives you the right to bring a claim elsewhere.
